Quick answer

A Thai property due diligence checklist runs 24 line items across title verification, encumbrances and mortgage release, construction permit, setback, easement, corporate seller standing, hoa or juristic person financials, tax arrears, and utility verification. A complete due diligence takes 7 to 14 working days with a Thai-qualified lawyer and costs 50,000 to 150,000 THB depending on transaction size, as of Q3 2026.

Title verification at the Land Department

The first check is the title itself. A Thai-qualified lawyer attends the Land Department in person with the seller's identification and verifies the Chanote or Nor Sor 3 Gor title, the front-page owner record, the reverse-side encumbrances, the existence of any mortgage, lease, easement, or court order, and the consistency of the plot shape with the registered drawing. A colour-coded map of the plot and its holders is issued on request. A faxed or photographed copy is not enough; the in-person check protects against temporary title deposits and undisclosed encumbrances.

Setback and reef check

On beachfront plots, the Department of Marine and Coastal Resources administers the setback. A letter confirming the verified high tide line and the applicable setback for the plot is required before any build. On inland plots, the local Administrative Organisation (OrBorTor) administers the Building Control Act setback and the height limits. A plot listed as land on the Chanote but falling within a designated buffer cannot be built as drawn in the brochure.

Construction permit and habitation certificate

A property without a construction permit is an illegal build and cannot pass title transfer in most cases. The permit is verified at the Local Administrative Organisation, with the building drawings and the as-built photographs checked against the permit file. A habitation certificate, or EIA compliance for developments over a certain size, is a parallel check. A villa with an unauthorised extension or pool has no permit and cannot pass transfer until the extension is removed or chartered under a fine.

Mortgage release and finance settlement

If the property is mortgaged, the mortgage must be released at the Land Department on or before the transfer day. The buyer's lawyer verifies the outstanding balance, requests a settlement statement from the seller's bank, and arranges the release fund flow at the transfer. The release takes 3 to 10 working days and must be factored into the transfer calendar.

Corporate seller standing

Where the seller is a Thai company the buyer's lawyer verifies the company at the Department of Business Development, including the current shareholder list, the directors, the registered capital, the most recent annual filing, the audited accounts, and any pending litigation. A company that has missed two consecutive annual filings is in administrative strike-off and cannot pass transfer until restored. This is a common failure on lower-price resales and should not be missed.

Juristic person financials for condominiums

For a condominium purchase, the buyer's lawyer requests from the juristic person manager the last three years of audited common area accounts, the current sinking fund balance, the maintenance fee arrears history, the foreign quota position, the current AGM minutes, and any pending or outstanding litigation against the building. A building that has run its sinking fund down is a hidden future cost.

Utility verification and plot access

Verify three-phase electricity, municipal water or well registration, and fibre internet availability at the plot or unit. Verify plot access by registered right of way if the plot does not front a public road. A plot with a locked or disputed access cannot be transferred without the access being resolved. A plot with an unregistered well has a future legal liability.

Tax arrears and outstanding liens

Outstanding property tax, land tax, utility bills, and any mechanic liens from contractors are checked at the relevant office. A seller with an unpaid builder can transfer but the buyer inherits the lien in many cases. House registration and any current tenant must be disclosed; a sitting tenant at transfer may have continuing rights.

The actual checklist file

A complete due diligence runs 24 to 32 line items depending on the asset, documented in a single PDF file from your lawyer, with each item checked against a primary source. A due diligence that is in the seller's handwriting or without primary source references is not a due diligence. Our practice refuses to complete a transaction where this standard cannot be met.

This guide is published as of the updated date shown above and reflects Thai land and tax rules current at that time. It is general information and not specific legal or tax advice. For a transaction, instruct a Thai-qualified lawyer or accountant.

Frequently asked questions

How long does Thai property due diligence take?

A complete due diligence takes 7 to 14 working days with a Thai-qualified lawyer. Mortgage release adds 3 to 10 working days, corporate seller verification adds 5 to 10 working days, and beachfront setback verification adds 14 to 21 working days.

What does due diligence cost in Thailand?

A complete due diligence costs 50,000 to 150,000 THB in 2026 depending on transaction size and complexity. The work is done by a Thai-qualified conveyancer and is the most reliable single investment in the transaction.

Can I do my own due diligence without a lawyer?

Some checks you can do: corporate seller standing online at the DBD website and the construction permit at the OrBorTor. Title verification at the Land Department requires the seller to consent to the in-person check, which is why a lawyer investigator is standard. Do not skip lawyer-led title check.

What is a Chanote and why does it matter?

A Chanote (Nor Sor 4) is the red title, with surveyed boundaries and full ownership. Nor Sor 3 Gor is the green title, and it is also a good title for a residential purchase. A green title can later be applied for as a red title. Nor Sor 3 without the Gor, Sor Por Kor 4-01, and a brown book are not suitable for a residential purchase.

How do I verify the foreign quota for a condominium?

The current foreign quota position for a building is held by the juristic person manager and verified at the Land Department at transfer. The quota can be exhausted for a building or for a specific unit size band within a building. A unit listed as foreign quota that turns out to be exhausted blocks freehold transfer.

What is the most common due diligence failure in Hua Hin?

Missing a corporate seller's overdue annual filing at the DBD, leading to an administrative strike-off that blocks transfer until restored. This is common on lower-price resales and should not be missed. The second most common is an unverified beachfront setback.

Do I need an Environmental Impact Assessment for a villa?

Not for a single villa. An EIA is required for developments of more than 100 units or buildings over 23 metres. For a villa in a development, the developer holds the EIA, and the buyer should verify the EIA approval letter and its compliance conditions.

Can a sitting tenant block a property sale in Thailand?

A sitting tenant at transfer does not block the sale but the tenancy runs with the property. A commercial tenancy can be terminated on proper notice. A residential tenancy runs to the end of its term unless the contract allows termination. Verify any sitting tenant and the lease terms before transfer.
